By participating in the Promotion, the participant accepts these Terms & Conditions of Participation.

1. Organiser
   1. The Promotion is being hosted by [Festool GmbH, Wertstr. 20, 73240 Wendlingen, Germany], ("Organiser").
   2. The Promotion is being implemented by the agency commissioned by the Organiser FULFILLERS GmbH, Joseph-Beuys-Allee 6, 53113 Bonn, Germany ("Agency").
2. Eligibility
   1. This promotion is made available to customers of Festool of legal age and legal resident in or based in the European Economic Area, Switzerland or the United Kingdom ("Area of Participation") are eligible to participate in the Promotion.
   2. Employees of the Organiser and its dealers, along with their employees, executives and representatives, shall be excluded from the Promotion.
3. Subject of the Promotion
   1. End customers who purchase a promotional product (see Point 4) within the promotional period from 18th March 2024 to 31st May 2024 in the Festool online shop or from an authorised Festool dealer in the Area of Participation and register for the Promotion by 14th June 2024 at the latest shall receive a free HighPower battery pack BP 18 Li 4.0 HPC-ASI ("Free Battery Pack") for every cordless combo set ("Promotional Product") purchased.
   2. A maximum of four (4) Promotional Products per person can be registered for the Promotion. The Free Battery Pack can only be applied once per Promotional Product as part of this Promotion. This Promotion includes all Festool 18V battery promotions being implemented in parallel in the Area of Participation, independent of the specific Organiser. A comparison of e-mail addresses, duplicate addresses and verification numbers shall be carried out. A maximum of four (4) people per household/company shall be permitted to participate in the Promotion. Multiple participations which violate these Terms & Conditions of Participation along with any other manipulative measures will lead to the participant's immediate exclusion from the Promotion.
4. Promotional Products
   1. Free Battery Packs shall be shipped according to the provisions of these Terms & Conditions of Participation for the products named in the Promotional Product list (to be found at www.festool.co.uk/18VPromotion). Only new goods qualify as Promotional Products; used products are excluded from the Promotion.
5. Participating in the Promotion
   1. As a prerequisite for participating in the Promotion, the end customer must have completely and properly disclosed and made available the following information within a current MyFestool account in their name by 14th June 2024:
      • Name and address of the participant
      • E-mail address of the participant
      • Purchasing date of the Promotional Product
      • Verification numbers (part no.) of the Promotional Product
      • Scan or photograph of an invoice or similar proof of purchase, on which the purchasing date and the product can be clearly identified
      • Delivery address for the Free Battery Pack if this differs from the address specified by the participant
   2. A sales platform certificate or a receipt do not provide sufficient proof of purchase. Furthermore, a proof of purchase must not have been issued to anybody other than the participant.
   3. If handing over the Free Battery Pack represents an advantage with regard to tax, the obligation to pay taxes shall remain with the recipient (end customer).
   4. After receiving the participation documents, the participant receives a confirmation of receipt by e-mail from Festool or the Agency as well as further status messages during implementation of the Promotion. Festool and the Agency commissioned by Festool for implementation shall be authorised to contact the participant by e-mail or letter if there are any queries regarding the implementation of the Promotion.
   5. There shall be no entitlement to participate should the information not be submitted on time, be illegible, incomplete or be otherwise incorrect.
   6. The Organiser reserves the right to disqualify participants and exclude them from future participation in the Promotion if they give incorrect or incomplete details, manipulate or try to manipulate the participation process and/or culpably infringe the rules of participation and/or otherwise attempt to obtain a service by fraud in an unfair and/or dishonest manner. In the case that a participant is justifiably excluded, the Organiser is entitled – also subsequently – to request that a Free Battery Pack that has already been handed over is returned.
6. Shipment of the Free Battery Pack
   1. The Agency is responsible for checking whether a Free Battery Pack can be claimed and for sending the Free Battery Pack to the delivery address specified by the participant
   2. The Free Battery Pack shall be shipped no later than 14 days after the complete participation documents, which must have been submitted on time and in the correct form, have been received.
   3. If there are errors in the delivery address specified by the participant, there shall be no claim to repeat shipment.
   4. The claim to shipment of the Free Battery Pack shall not be transferable. Payment in cash or in tangible assets is excluded.
7. Obligation to return if the product is returned
   1. If a Promotional Product that has already been registered to the Promotion is returned within six months, this shall void the claim to the Free Battery Pack. Any benefits already granted must be reimbursed.
8. Data privacy
   1. The data provided by the participants as part of the Promotion shall be processed by the Organiser exclusively for the implementation of the Promotion, as specified in these Terms & Conditions of Participation. The legal basis for this data processing is Article 6(1a) General Data Protection Regulation (GDPR). Participants can object to the processing of their data at any time. If they withdraw this consent, the relevant participant's data shall be deleted immediately – further participation in the Promotion will then unfortunately no longer be possible.
   2. It may be necessary to transfer the participant's personal data to the Agency for the purpose of implementing the Promotion. In addition, data may be passed on for hosting purposes.
   3. Once the Promotion has ended, the participants' personal data shall be erased within three (3) years, provided this does not contravene any statutory data retention obligations. You can find further information on data privacy at: https://www.festool.co.uk/legal-information/data-protection.
9. Other
   1. The Organiser reserves the right to change, extend or prematurely end this Promotion without prior notice.
   2. These Terms & Conditions of Participation are subject to national law at the Organiser's registered office to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for all disputes shall be the location of the Organiser's registered office.
   3. Should one or several provisions of these Terms & Conditions of Participation be or become ineffective, the validity of the remaining provisions shall not be affected thereby.
